Commercial Real Estate & Construction Law
Property and construction projects in Sweden follow well-established legal frameworks and widely used industry standard contracts. Foreign companies leasing premises, investing in property or participating in construction projects benefit from understanding these conventions early.
We advise international businesses on commercial leases, property-related agreements and construction contracts, as well as disputes arising from them.

- Negotiating commercial leases and understanding tenant security of tenure
- Rent adjustments, maintenance obligations and lease termination

Swedish property and construction law
The Land Code (jordabalken, 1970:994) governs real property, including the transfer of property and, in Chapter 12, leases of premises. Termination of a commercial lease must follow strict formal requirements, and errors in a notice of termination can render it ineffective.
Construction projects in Sweden are commonly governed by standard terms agreed within the industry, such as AB 04 for traditional contracts and ABT 06 for design-and-build contracts. These terms are not statutes; they apply only where the relevant version has been incorporated into the agreement, and they contain detailed rules on time extensions, variations, inspections and liability for defects.
Planning permission and building permits are regulated by the Planning and Building Act (plan- och bygglagen, 2010:900), administered by the municipalities.

Frequently asked questions
Can a commercial tenant in Sweden waive security of tenure?
Yes, under certain conditions. The waiver must normally be made in a separate agreement and, in many cases, approved by the regional rent tribunal (hyresnämnden).
Are the AB and ABT standard terms mandatory?
No. They apply only if the parties agree to them, and the parties can make amendments. In practice, they are widely used in Swedish construction projects.
Do you handle residential property matters?
Our focus is commercial. Residential matters for private individuals are outside our practice area.
